MEMO FAMILY & CARER AGREEMENT

- Purpose
This Family & Carer Agreement (“Agreement”) sets out the terms that apply to family members, friends and informal carers who access or use the Memo platform to support another person (“Primary User”).
Its purpose is to:
- protect the rights, dignity and privacy of the Primary User;
- establish clear responsibilities for family members and carers;
- promote safe and respectful use of Memo;
- support effective communication between authorised users; and
- safeguard vulnerable individuals.
This Agreement forms part of the Memo Legal Framework and should be read together with the:
- Terms of Use;
- Privacy Notice;
- Authority, Capacity & Representation Policy;
- Acceptable Use Policy;
- AI Transparency & Responsible AI Statement; and
- Safeguarding & Emergency Escalation Policy.
- Who This Agreement Applies To
This Agreement applies to any individual who accesses Memo on behalf of, or in support of, a Primary User, including:
- spouses and partners;
- parents;
- adult children;
- siblings;
- other relatives;
- close friends;
- neighbours;
- unpaid carers;
- other individuals authorised to support the Primary User.
It does not apply to professional carers or organisations, who are governed by the Professional User Agreement.
- Authority to Access Memo
You may only access or administer another person’s Memo account where:
- the Primary User has given informed permission;
- you have lawful authority to act on their behalf;
- you have been granted access by an authorised representative; or
- access is otherwise permitted under applicable law.
You must not claim authority that you do not possess.
If your authority changes or ends, you must notify Memry promptly.
- Permissions and Access Levels
Memo supports different levels of access depending upon your relationship with the Primary User.
Permissions may include, where authorised:
- viewing information;
- receiving notifications;
- sending messages;
- updating reminders;
- managing appointments;
- contributing to the Memry Vault;
- responding to wellbeing alerts;
- updating emergency contacts;
- administering subscription details where authorised.
Not every family member will receive the same level of access.
Access permissions may be changed by the Primary User or another authorised representative at any time, subject to applicable law.
- Shared Access
Where multiple family members or carers have access to the same account:
- each person is responsible for their own actions;
- account credentials must not be shared unless expressly authorised;
- users should cooperate respectfully in supporting the Primary User;
- duplicate or conflicting changes should be avoided;
- users should communicate with one another where appropriate.
Memry is not responsible for disagreements between family members regarding care decisions or account management.
- Responsibilities of Family Members and Carers
When using Memo you agree to:
- act honestly and lawfully;
- respect the wishes and dignity of the Primary User;
- act in their best interests where authorised to do so;
- maintain confidentiality;
- keep information accurate where you update it;
- use the Service only for its intended purpose;
- report safeguarding concerns where appropriate;
- protect your account credentials.
You remain responsible for decisions you make when supporting another person.
- Privacy and Confidentiality
Information accessible through Memo may include personal, sensitive or confidential information.
You agree to:
- access only information you are authorised to view;
- keep information confidential;
- avoid sharing information unnecessarily;
- comply with applicable data protection legislation;
- respect the privacy of all users.
Personal information must not be disclosed to third parties without lawful authority.
- Messaging and Communication
Memo may allow authorised users to exchange messages, reminders and other communications.
You agree to communicate:
- respectfully;
- honestly;
- constructively;
- without harassment or intimidation.
You must not use Memo to:
- threaten another person;
- bully or abuse users;
- manipulate vulnerable individuals;
- send unlawful or offensive communications;
- impersonate another individual.
Memry may moderate or investigate communications where reasonably necessary to protect users or comply with legal obligations.
- Notifications and Alerts
Memo may generate notifications relating to:
- reminders;
- appointments;
- wellbeing check-ins;
- inactivity;
- location events;
- emergency contacts;
- other authorised functions.
Notifications are provided to assist care coordination.
Delivery cannot be guaranteed.
Users must not rely exclusively upon notifications where immediate intervention may be required.
- Monitoring Features
Where enabled and authorised, Memo may provide monitoring-related features, including:
- wellbeing check-ins;
- inactivity detection;
- location services;
- geofence notifications;
- optional camera or audio functions;
- emergency alerts.
These features are intended to support—not replace—human supervision.
Monitoring may occasionally fail because of technical limitations, connectivity issues or user circumstances.
Family members remain responsible for determining what level of personal supervision is appropriate.
- Emergency Situations
Memo is not an emergency response service.
In any emergency you should immediately contact the appropriate emergency services.
Although Memo may attempt to notify authorised contacts, delivery of alerts cannot be guaranteed.
Users must not rely solely upon Memo to protect the safety of the Primary User.
- Appropriate Use
Family members and carers must comply with the Acceptable Use Policy.
You must not:
- misuse another person’s account;
- deliberately provide false information;
- interfere with security;
- misuse monitoring features;
- attempt unauthorised access;
- exploit vulnerable individuals;
- use Memo for unlawful purposes.
- Safeguarding
If you become aware of:
- suspected abuse;
- neglect;
- exploitation;
- coercion;
- financial abuse;
- significant safeguarding concerns,
you should take appropriate action in accordance with applicable law and, where relevant, the procedures of the organisation responsible for the individual’s care.
Memry may restrict access or investigate concerns where reasonably necessary to protect users.
- Suspension of Access
Memry may suspend or remove your access where:
- your authority has ended;
- misuse is suspected;
- safeguarding concerns arise;
- these Terms are breached;
- continued access may place a user at risk.
Where reasonably practicable, Memry will explain the reasons for such action.
- Changes in Circumstances
You must notify Memry if:
- your relationship with the Primary User changes;
- your authority changes;
- the Primary User dies;
- another person becomes legally responsible;
- you believe account permissions should be updated.
- Liability
Family members and carers remain responsible for the decisions they make while supporting the Primary User.
Nothing within this Agreement transfers responsibility for care decisions to Memry.
Memo provides tools to assist communication and care coordination but does not replace personal judgement, family involvement or professional advice.
- Changes to this Agreement
Memry may amend this Agreement to reflect changes in law, regulation or the development of the Memo platform.
Material changes will be communicated through the Service or by other appropriate means.
Continued use of Memo after the effective date of any revised Agreement constitutes acceptance of those changes.
